Moonlight Technologies Terms of Service

These Terms of Service (“ToS”) govern your use of Moonlight Technologies' hardware and software titled “Moonlight: Color”, “Moonlight: AI”, & “Moonlink” (“Software” and “Device”). By using the Software or Device, you agree to the terms outlined below. If you do not agree, do not install or use the Software or Device.

License

Moonlight grants you a non-exclusive, non-transferable, limited license to use the Software and Device under these terms. This includes use for applications requiring precise mouse movements.

Intended Use & Inclusivity

The Software and Device are designed to assist users, particularly individuals with physical or mental disabilities, in applications requiring precision. Moonlight promotes accessibility and inclusivity, ensuring compliance with disability rights laws like the ADA. Moonlight is not designed or intended to provide a competitive advantage to non-disabled users. It is intended exclusively as an assistive input tool for individuals with disabilities. Any use outside of this scope is not endorsed by Moonlight Technologies and may result in license termination.

Permitted Use

You may use the Software and Device for applications requiring precise mouse movements, including assistive technologies for users with disabilities. You are responsible for complying with third-party terms of service.

Prohibited Use

The Software and Device are intended to support applications requiring precise mouse movements, including assistive technologies designed to aid individuals with disabilities. It is your responsibility to ensure that your use complies with applicable laws, regulations, and the terms of service of any third-party platforms or services.

User Data

Moonlight collects data, including hardware IDs and authentication information, for security purposes. By using the Software and Device, you consent to data collection in line with Moonlight's privacy policy and applicable regulations, including GDPR and CCPA.

No Warranty

All software, devices, and materials are provided “as-is,” without any warranty of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. You assume full responsibility for any consequences arising from their use, including but not limited to potential errors, malfunctions, hardware incompatibilities, or account bans.

Setup & Troubleshooting

The Software is a high-performance technical tool. By purchasing, you acknowledge that installation and configuration are your sole responsibility.

  • Mandatory Cooperation: If you request technical assistance, you are contractually obligated to follow all troubleshooting steps provided by Support. This includes, but is not limited to: updating drivers, disabling conflicting security software, and performing a clean reinstallation of the Operating System (Windows) on the target or secondary machine if Support deems it necessary.
  • Failure to Cooperate: Refusal to perform requested troubleshooting steps, or providing false information regarding hardware/software specifications, constitutes a voluntary abandonment of your support request. In such cases, the Software is deemed “functional as delivered.”
  • Hardware Responsibility: Moonlight does not guarantee functionality on hardware not explicitly listed as “Certified Compatible.” Support provided for mobile processors (Laptop CPUs), integrated graphics, or “borderline” specifications is a courtesy only and does not imply a guarantee of performance.

Digital Access & Finality of Sale

Due to the nature of digital content and immediate license/access delivery, purchases are final once digital access is provided, except where applicable law requires a refund or other remedy.

  • Final Sale Policy: Digital license purchases are final after access is delivered, except where applicable law requires a remedy, including non-delivery, duplicate charge, unauthorized charge, or non-conforming digital content or service.
  • Immediate Access and Withdrawal Acknowledgement: At checkout you may request immediate digital delivery. Where a statutory cooling-off or withdrawal right applies to digital content, requesting immediate access and receiving delivery may end that right to withdraw, except where applicable law requires otherwise.
  • Payment Disputes: If a payment dispute or chargeback is opened after digital access has been delivered, we reserve the right to provide order records, checkout acknowledgements, email confirmations, support history, license activation timestamps, and relevant technical logs to the payment processor or banking institution as evidence of service delivery.

Termination

Moonlight reserves the right to terminate your license and revoke access to the Software or Device for non-compliance with these terms or for abusive behavior toward staff.

Liability & Indemnification

Moonlight is not liable for damages or penalties arising from the use of the Software or Device, including account suspensions or bans imposed by third-party platforms. You agree to indemnify Moonlight from any claims resulting from your use.

Compliance & Assumption of Risk

You are responsible for ensuring that your use of the Software and Device complies with all applicable third-party terms of service. Moonlight is not liable for penalties resulting from third-party violations. Some platforms may not distinguish between assistive use and misuse. You assume all risks associated with platform enforcement actions, regardless of your intent.

Content Ownership & Distribution Restrictions

Any content, including but not limited to guides, documentation, announcements, discussions, videos, or support responses, posted by Moonlight staff or other users within Moonlight's platforms (e.g., Discord, forums, private communications, or any other official channels) is proprietary. This content may not be shared, reposted, recorded, or distributed outside of the Moonlight ecosystem without explicit written permission from Moonlight Technologies.

Modifications

Moonlight reserves the right to modify these terms at any time. Continued use of the Software or Device signifies your acceptance of the revised terms.

Dispute Resolution & Governing Law

Disputes will be resolved through binding arbitration in accordance with the laws of the USA.

Force Majeure

Moonlight will not be liable for delays or failures due to causes beyond its control, such as natural disasters or legal changes.

Security & Process Monitoring

Moonlight Technologies implements security measures to prevent unauthorized modifications, reverse engineering, or other prohibited uses of the Software and Device.

Competitive & Professional Use

The Software and Device are not intended for use in professional, tournament, or cash-prize esports environments. You may not use Moonlight technologies in any setting where monetary prizes, professional rankings, salaries/financial compensation, or formal professional recognition are awarded.

This includes, but is not limited to:

  • Official publisher-run esports tournaments (e.g., VCT, Fortnite Cash Cups, CDL, OWL).
  • Third-party professional ladders or leagues (e.g., FPL, ESEA Premier, BLAST, ESL Pro League).
  • Cash-prize competitions hosted by publishers, organizers, or third-party platforms.

By purchasing and/or using the Software or Device, you acknowledge the risks, including non-compliance with third-party terms, and release Moonlight from any related liability.
