Moonlight Technologies Terms of Service

These Terms of Service (“ToS”) govern your use of Moonlight Technologies' hardware and software titled “Moonlight: Color”, “Moonlight: AI”, & “Moonlink” (“Software” and “Device”). By using the Software or Device, you agree to the terms outlined below. If you do not agree, do not install or use the Software or Device.

License

Moonlight grants you a non-exclusive, non-transferable, limited license to use the Software and Device under these terms. This includes use for applications requiring precise mouse movements.

Intended Use & Inclusivity

The Software and Device are designed to assist users, particularly individuals with physical or mental disabilities, in applications requiring precision. Moonlight promotes accessibility and inclusivity, ensuring compliance with disability rights laws like the ADA.

Permitted Use

You may use the Software and Device for applications requiring precise mouse movements, including assistive technologies for users with disabilities. You are responsible for complying with third-party terms of service.

Prohibited Use

Do not use the Software or Device for illegal activities, unauthorized modifications, or harmful interference with other users or systems.

Account Security and Restrictions

The following activities are strictly prohibited and will result in immediate account termination without refund:

  • Sharing your account credentials with others or allowing unauthorized access to your account
  • Any attempts to crack, reverse engineer, or bypass our software's security measures
  • Creating new accounts or using different hardware identifiers to evade previous bans
  • Operating multiple accounts to circumvent limitations or restrictions
  • Using modified or unauthorized versions of our software

If you were previously banned, attempting to create new accounts or access our services may result in immediate termination without notice and potential legal action. We maintain records of banned accounts, hardware identifiers, and associated information to enforce these restrictions.

User Data

Moonlight collects data, including hardware IDs and authentication information, for security purposes. By using the Software and Device, you consent to data collection in line with Moonlight's privacy policy and applicable regulations, including GDPR and CCPA.

No Warranty

The Software and Device are provided “as-is,” without any warranty. You assume full responsibility for consequences arising from their use.

Latency

Variability in latency may occur, especially in dual-PC setups. Moonlight is not responsible for performance issues related to latency.

Technical Expertise Required

Advanced technical skills may be needed for setup and operation. Significant adjustments may be required for optimal performance.

No Refunds

No refunds will be issued under any circumstances.

Termination

Moonlight reserves the right to terminate your license and revoke access to the Software or Device for non-compliance with these terms.

Liability & Indemnification

Moonlight is not liable for damages or penalties arising from the use of the Software or Device, including account suspensions or bans imposed by third-party platforms. You agree to indemnify Moonlight from any claims resulting from your use.

Compliance & Assumption of Risk

You are responsible for ensuring that your use of the Software and Device complies with all applicable third-party terms of service. Moonlight is not liable for penalties resulting from third-party violations.

Modifications

Moonlight reserves the right to modify these terms at any time. Continued use of the Software or Device signifies your acceptance of the revised terms.

Dispute Resolution & Governing Law

Disputes will be resolved through binding arbitration in accordance with the laws of the United States of America. Any arbitration proceedings will be conducted in the United States.

Force Majeure

Moonlight will not be liable for delays or failures due to causes beyond its control, such as natural disasters or legal changes.
